Terms of Service

Welcome to Nanny Portal. These Terms of Service ("Terms") govern your use of the Nanny Portal website and services (the "Platform"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. What Nanny Portal Is — and Is Not

Nanny Portal is a marketplace that helps caregivers, families, and staffing agencies find and connect with one another.

2. Eligibility and Accounts

• You must be at least 18 years old to create an account.
• You agree to provide accurate, current, and complete information, and to keep it updated.
• You are responsible for your account credentials and all activity under your account.
• Accounts may be reviewed before going live, and we may decline, suspend, or remove accounts that violate these Terms or our community standards.

3. For Caregivers

• All experience, certifications, references, and credentials you present must be truthful and verifiable.
• Caregivers may be required to complete a background check through our designated partner before their profile becomes publicly visible.
• You are an independent professional. Nanny Portal does not set your rates, schedule, or working conditions.

4. For Families and Agencies

• You are solely responsible for evaluating, interviewing, selecting, and supervising anyone you engage. We encourage you to independently verify references, credentials, and fit.
• You are responsible for complying with all laws that apply to any employment relationship you create, including wage, tax, and labor laws. Employment contracts are between you and the caregiver — Nanny Portal is not a party to them.
• Agencies must identify themselves as agencies in all communications on the Platform.

5. Background Checks and Verification

Where offered, background checks and verification badges reflect information available at a point in time and are provided for informational purposes only. They are not a guarantee of anyone's identity, qualifications, or future conduct. If you use a background check or consumer report in a hiring decision, you are responsible for complying with the Fair Credit Reporting Act (FCRA) and any applicable state laws.

6. Fees and Subscriptions

• Certain features require a paid plan. Current pricing is shown on our Pricing page.
• Subscriptions renew automatically until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
• Except where required by law, fees are non-refundable.
• We may change pricing with reasonable advance notice; changes apply from your next billing period.

7. Reviews and User Content

• Reviews and ratings must reflect your honest, first-hand experience. Fake, retaliatory, or defamatory reviews are prohibited.
• By posting content (profiles, reviews, messages, photos), you grant Nanny Portal a non-exclusive license to display that content on the Platform for the purpose of operating the service.
• We may moderate, edit for format, or remove content that violates these Terms, but we are not obligated to monitor all content and are not responsible for content posted by users.

8. Prohibited Conduct

You agree not to:

• Misrepresent your identity, qualifications, household, or business;
• Harass, threaten, or discriminate against other users;
• Use the Platform for any unlawful purpose, including unlawful employment practices;
• Scrape, copy, or harvest data or profiles from the Platform;
• Post content that is false, infringing, obscene, or harmful;
• Circumvent safety features or attempt to access another user's account.

9. Safety

Your safety matters to us, but no platform can eliminate risk. Exercise the same judgment you would in any hiring or job-seeking situation: meet in appropriate settings, check references, and trust your instincts. 10. Disclaimers

The Platform is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or that any user's information is accurate.

11. Limitation of Liability

To the fullest extent permitted by law, Nanny Portal and its owners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any dispute, injury, or loss arising from interactions or arrangements between users. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim arose.

12. Indemnification

You agree to indemnify and hold harmless Nanny Portal from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your content, your violation of these Terms, or your interactions with other users.

13. Termination

You may close your account at any time from account settings. We may suspend or terminate accounts that violate these Terms, pose a safety risk, or misuse the Platform. Sections that by their nature should survive termination (including 10–12) will survive.

14. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you by email or through the Platform before they take effect. Continued use after changes take effect constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in San Francisco County, California.
